The SMA was signed on December 14, 2020 and secures reciprocal, facilitated market access for service providers from Switzerland and the UK from January 1, 2021 and for an initial limited period of two years.
The SMA allows Swiss businesses to continue to use services from UK companies for up to ninety days per year. In the UK, market opening towards Switzerland is achieved through market access commitments in over thirty sectors such as tax advice, R&D, IT expertise, insurance advisory services, and other financial advisory and consulting services. In addition, the UK grants Swiss service suppliers further preferential treatment. Swiss service suppliers are not subject to an economic needs test for access to these sectors in the UK and are not required to provide evidence of English language proficiency. Service suppliers from Switzerland can stay in the UK for up to twelve months in any twenty-four month period. Consequently, the SMA continues to allow Swiss companies extensive market access in the UK for contract-based service provision by natural persons.
The consultation period was launched on February 17, 2021 and will last until April 30, 2021.
